IMPORTANT-READ CAREFULLY: POTOMACSOFT LICENSES THE SOFTWARE TO YOU ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS LICENSE AGREEMENT. BEFORE YOU INSTALL THE SOFTWARE, PLEASE READ THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU SHOULD CLICK THE "NO" BUTTON, AND DO NOT INSTALL THE SOFTWARE ON YOUR MACHINE. BY CLICKING ON THE "YES" BUTTON, YOU ARE CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT.

This Agreement may only be modified by a license addendum that accompanies this license or by a written document that has been signed by both you and PotomacSoft Inc.

In this License Agreement, PotomacSoft Inc is a company registered in the state of Maryland, USA (check our website http://www.potomacsoft.com/ for address and contact information changes). "Registered Version" means you have purchased the license key and installed by using setup dialogbox. Only direct connection will require a license key after trial period. "Host Program" is the software needs to be installed on the machine to be operated by another machine. "Client Program" is the software that needs to be installed on the machine to operate the other machine (the host machine). "TeleDesktop" Software (also referred as "the software" or "this software" in this agreement) is the software including the host program, the client program and other supporting components/files.

LICENSE AND WARRANTY:

TeleDesktop software is a property of PotomacSoft Inc and is protected by copyright law. While PotomacSoft continues to own the software, you will be granted certain rights to use the software after your acceptance of this license agreement. Your rights and obligations with respect to the use of this software are as follows:

YOU MAY:

1. Install the software on any computers.

2. Use SBC connections without license keys. You may use SBC guest account free with limitations.

3. You can trial Direct Connection free for 30 days after the initial installation with full capabilities. After 30 days period, trial is extended on even days without a license key.

4. Install and use TeleDesktop client software on any computer without license key.

5. If you bought a multi-machines license key, it can only be installed within your corporation.

6. After written notice to PotomacSoft Inc, you may transfer license key(s) on a permanent basis to another person or entity, provided that you will not make direct connection using this software and the transferee agrees to the terms of this agreement. The written notice must include the license key(s) and information of both you and the transferee with minimum of correct names and addresses.

YOU MAY NOT:

1. You must NOT modify, reverse engineer, decompile, decode, disassemble, sell, rent, lease or redistribute any or all portions of this software except that you may redistribute entire installation package from our authorized distribution channel without additions, reductions and/or modifications.

2. You must NOT produce, reproduce or distribute license key(s) except you have a written permission from PotomacSoft Inc.

3. You must NOT install illegal license key on your computer.

4. When you bought license key, you must NOT install the license key on the number of the computers more than authorized to install

5. You may not share a multi-machines license key with another corporation/enterprise.

NO REFUND:

You may use trial version of the software that is fully functional for 30 days after initial installation and buy the license key after satisfied with trial version. After license key(s) are bought, it is not refundable.

LIMITED WARRANTY:

The only warranty PotomacSoft Inc makes is that the license key(s) bought from PotomacSoft Inc will function properly as designed. In case the license key(s) do not work, PotomacSoft will, in its own choices, replace the defective license key(s) or refund the money you paid for the license key(s), provided that PotomacSoft Inc is notified in written within 30 days from purchase of the license key(s).

The software and any documentation are provided "AS IS". PotomacSoft Inc does not warrant that the software will meet your requirements or that operation of the software will be uninterrupted or that the software will be error-free.

TERMINATION:

This license is in effect until terminated. Failure to comply with the limitations set forth in this agreement shall result in automatic termination of this license. Upon termination YOU or YOUR representative shall destroy all copies of the software and all of its component parts and documents. Also you are NOT allowed to use the software in any way upon termination.

SBC SUBSCRIPTION:

If you want to use SBC connection, it does not require a license key. You may optionally subscribe SBC (Server Based Connection) service separately with fee. This license agreement DOES NOT include SBC subscription. SBC services could be useful to you for passing firewalls and solving the problem with dynamic IP addresses. Check http://potomacsoft.com/ for further information about SBC subscription and agreement.

DISCLAIMER OF DAMAGES:

To the maximum extent permitted by applicable law, in no event shall PotomacSoft or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) directly or indirectly arising out of the use or misuse of this software, even if PotomacSoft has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

In no case shall PotomacSoft's liability exceed the money you paid for purchase of the software and license key(s).
